Dad fights for custody of daughter after two sons killed in Nassau crash

A father is fighting for custody of his daughter after a Nassau County mother crashed an SUV into a pole, killing both of their sons.

Action News Jax spoke with Andrew Lee Bird after he filed two emergency motions.

Bird said he wants custody of their daughter, Nina, who is still recovering in the hospital after Saturday’s crash.

Bird said he is also fighting for the remains of his two sons, Nick and Nehemiah, who were killed.

"I’m not going to make any further comment. I just want to get to my daughter, " Bird said.

Bird said he flew in from Michigan after finding out about the crash involving three of his kids.

"We've been down here since Sunday. Sunday night, when we found out,” Bird said.

Tonya Capallia-Eason was driving eight children in her SUV Saturday after allegedly drinking at a Halloween party.

Florida Highway Patrol said that instead of turning right at a dead end, she went straight into a utility pole and it caused her vehicle to overturn.

Her two sons were killed and six other kids, ages 15 and under, were seriously hurt.

Action News Jax dug into Nassau County court records and found both Bird’s and Capallia-Eason’s names attached to several documents dating back to 2014, including a domestic case and a child support order.

However, Action News Jax Law and Ssafety expert Dale Carson said access to those files is restricted.

The court hearing will resume Wednesday at 11 a.m.
