A Jacksonville man accused of sexually abusing an elderly woman in his care is not facing criminal charges.
The Florida Department of Health says 31-year-old Brandon Young, a nursing assistant with St. Vincent's Medical Center, is accused of fondling a 74-year-old woman in May.
He is currently restricted from working with female patients but Action News Jax learned he's not facing any charges from police.
According to Florida statute, the health department is required to report Young's alleged criminal violation to law enforcement.
The health department was unable to provide Action News Jax proof they did and there's no record of Young being arrested in Clay or Duval counties for a sex crime.
The State Attorney's Office said they can't confirm or deny there's an investigation.
Young said he had no comment when Action News Jax went to his home.
Young has a prior arrest in 2011 for domestic battery.
St. Vincent's sent Action News Jax this statement:
We take patient safety seriously and conduct rigorous background checks on all employees. We will continue to work with state authorities in the investigation of this matter."
St. Vincent's wouldn't comment on if Young is still an employee. He has until Oct. 14 to file an appeal with the state.
