Jacksonville man at odds with city after dump truck damages his car

JACKSONVILLE, Fla. — A Jacksonville man said a City of Jacksonville dump truck caused thousands of dollars of damage to his car, but the city is refusing to pay for all of it.

Tony Ross said he was driving to work on the Arlington Expressway when a Public Works truck spilled rocks onto the road.

“They hit a bump in the middle of the road and next thing you know, the tailgate on the dump truck opens up and just starts throwing out rocks left and right,” Ross said.

Several rocks hit his Mercedes, causing dents and chipping the paint.

He said he tried to flag down the driver, but they kept going.

Ross pulled over and called the Jacksonville Sheriff's Office to file a police report.

He also called the city and filed a complaint online.

Ross took his car to a body shop and was told it would cost at least $11,000 to fix.

“They have to replace the hood. They have to replace the fenders,” Ross said.

He said the city sent out its own adjuster. The city offered him around $2,700.

“That’s an insult,” Ross said. “It wasn’t my fault. I shouldn’t have to come out-of-pocket for anything.”

Action News Jax dug through city claims against Public Works from 2016 to 2018 and found out of 3,178 claims filed against the city, only 882 were paid a settlement.

There were seven claims involving rocks damaging vehicle and property, but the city never paid a penny on any of those.

Ross said he plans to hold out with hopes the city will pay out the full price. If not, he said he plans to seek legal counsel.
