Report: Teen took video of alleged rape at Terry Parker High School

JACKSONVILLE, Fla. — New court documents show the football coach at a local high school turned in one of his players after he found out there was video of a sexual encounter with an underage girl on the player's cellphone.

Three Terry Parker High School students were arrested last week, accused of raping a classmate on campus during their lunch period.

The girl, who is between the ages of 12 and 15, told police it happened inside the school’s field house, which is used for weight training and athletic equipment storage.

The girl told police 18-year-old Nicholas Evans, 19-year-old Lavell Benjamin, and 17-year-old Nicholas Austin forced her to perform oral sex, and two of them forced her to have sexual intercourse.

“She doesn’t want to speak to anyone. She’s said what she has to say and she’s done with it. She’s done. We’re dealing with it. We have a lawyer and that’s it,” said the aunt of 18-year-old Nicholas Evans, when Action News Jax tried to speak to the suspect’s mother.

A court document shows Terry Parker HS football Coach Tommy Balom told the Jacksonville Sheriff's Office that Evans, who is one of his football players, had video on his cellphone of the encounter.

The report said Evans voluntarily showed an officer two videos on his phone. One showed three men having sex with a girl, but no faces. The second video showed the victim’s face.

“They want to see if the victim is in distress, if she’s saying certain things such as, 'Stop, I don’t want to do this, please don’t hurt me,’” said Action News Jax Crime and Safety expert Ken Jefferson.

Jefferson said it doesn’t matter if the girl consented or not; the three teens will still be charged because of her age and the video that reportedly shows what happened.

“They’re having sex with a child. And that’s against the law. They’ll be charged with lewd and lascivious act upon a minor child. So they will face charges one way or the other,” said Jefferson.

Benjamin’s neighbor, Will Smith III, said he’s surprised to hear what the 19-year-old is accused of.

“From what I’ve known of him, we throw the football, we talk. He’s very into his sports. But again, I can’t tell you what he would or wouldn’t do. But he’s always been super-polite to me,” said Smith.

Action News Jax asked Duval County Public Schools spokesman Mark Sherwood how the field house building and those four students were unsupervised long enough for this to happen. Sherwood said he can’t answer any questions about what happened because of the ongoing investigation.

Evans is still in jail.

Oliver did not answer the door or return Action News Jax’s call.

Benjamin’s sister walked away from Action News Jax’s questions, and calls to his family were not returned.
