Family, Takata settle airbag lawsuit

JACKSONVILLE, Fla. — The Mincey v. Takata Japan and Takata USA case was resolved.

A mutual agreement has been reached between the family of a woman injured by a Takata airbag and the company, according to lawyers.

Patricia Mincey died in April, two years after a crash left her paralyzed from the neck down. The victim’s attorney said a defective Takata airbag crushed Mincey’s spine.

The family for Mincey was seeking punitive damages for her death.

Lawyers met Friday morning for a hearing at the Duval County Courthouse.

The family’s lawyer, Ted Leopold, said that while he wasn’t necessarily expecting the settlement on Friday, the Mincey family is pleased.

The family was originally hoping that the CEO of Takata would testify during trial.

Leopold said they came to a financial agreement, but he couldn’t go into details.

“I wasn't expecting it,” Leopold said. “We came here (Friday) morning with some important issues to be addressed. Trial was set for October. But when both parties act in good faith with attempts to resolve matters in dispute it's not uncommon to have resolution.”

Leopold said the family can now move on with their lives.

Action News Jax tried talking to Takata lawyers, but they didn’t want to comment.

It is estimated that one in eight vehicles is affected by the Takata airbag recall, according to reports.
