JACKSONVILLE, Fla. — Michael Dunn's attorney Waffa Hanania filed a motion Tuesday to change the venue for his murder retrial, according to court records.
The motion cited "a tremendous amount of pretrial publicity in Duval County, Florida, some of which has been erroneous and misleading," as one of the reasons for the requested change in venue.
The request asks that Dunn's case be tried by "qualified jurors residing in another county in the state of Florida and so that the Defendant can receive a fair trial, by fair and impartial jurors who have not been tainted by pretrial publicity, public opinion, or any other factor."
Dunn shot and killed 17-year-old Jordan Davis after a fight about loud music, police say.
A jury convicted Dunn in February of three counts of attempted murder for shooting at Davis' three friends.
In addition to the motion for change of venue, Hanania also filed the following motions on behalf of Dunn:
-To have a sequestered jury
-Court prohibits the use of the term "victim" when referring to Davis
-No use of photos of "alleged drawings" from inside Dunn's cell
-Use of photos of Davis "other than the specific injuries, would be irrelevant, improper and prejudicial," the motion states.
-"To prohibit spectators from wearing items that depict support"
-Asking the court to not allow "any comments relating to the defendant's actions, or inactions, past and present, regarding any time frame outside the indictment"
Dunn's next court date is set for Monday.
